As we begin the summer season, we wanted to give you an update on Short-Term Rentals (Bill 41), which was signed into law the first week of May. The Department of Planning and Permitting (DPP) has approximately 180 days to create the rules and administrative dates for this new law to take effect. In the meantime, Bill 89 is still in effect. Bill #89 had allowed for 30-days or less in the short term rental market for those units in the A1 and A2 resort zoning and for other units with a non-conforming use (NCU) permit.
Bill 41 replaces the 30-days or less rental term with 90 days minimum. The concept stemmed from some neighborhoods in which Owners may be operating B&Bs, whether NCU units or not, and other neighbors in the area felt that there was a disturbance stemming from the frequent visitors coming and going from those short-term rental units within those residential neighborhoods. The DPP found it difficult to not only regulate, but to trace these particular rental units and its Owners.
At the present time, Owners should be aware that Bill 41 has been signed to become effective in approximately 180 days (October 2022), for a minimum of 90-day rental periods. For Owners who would like to verify the zone(s) in which their rental units are located, they may submit an application for Verification of Zoning to the DPP. There is a fee for $150, and a minimum 30 days wait for a response from DPP. This application is only for verification of zoning purposes only. The DPP is not currently accepting any new Non-Conforming Use (NCU) applications until October 23, 2022.
Owners should plan for 90 days minimum rental periods. Although there are moving parts to Bill 41 it has already been signed into law and will take effect on October 23, 2022.
